Understanding the divorce process in Massachusetts

In Massachusetts, you need a certified Marriage Certificate to file for divorce. If both parties agree on every issue, you can file an Uncontested Petition with a Full Agreement; when the parties disagree, you need to file a Contested Petition. Uncontested divorces become final 120 days after the date of the court hearing, with any legal name change going into effect 30 days after the hearing date.

Contested divorces vary significantly in timeframe depending on the number and complexity of issues that are contested, typically between eight and 14 months. The divorce becomes final 90 days after the date of the final court hearing.

Massachusetts law also requires divorcing or separating parents (including parents who were never married) to complete a parenting course prior to the final court hearing in cases where there is one or more child under the age of 18. These classes are intended to help parents understand and handle the challenges that separation poses to their families and address the stress that children may experience as a result of the separation.
